The Dixinn Court of First Instance on Monday, 3 July 2023, heard the objections raised by the lawyers of the Minister of Justice, Albert Charles Wright, who is being prosecuted for “defamation, public insults and abuse of authority” by leaders of the National Front for the Defence of the Constitution (FNDC).
At the opening of the hearing, Judge Ibrahima Sory 2 Tounkara declared the court incompetent and referred the civil party to “better legal proceedings”.
“The National Coordination of the FNDC takes note of the decision of the Court of First Instance of Dixinn declaring itself incompetent to hear the case of the leaders of the FNDC against Mr Alphonse Charles Wright,” the plaintiffs said.
Their lawyers have decided to appeal and say they will take the case “to other national and supranational jurisdictions as of Monday 3 July to ensure that the perpetrator of a serious human rights violations is held accountable”.
The National Coordination of the FNDC reminds the military junta that in Guinea “impunity cannot be granted to any category of persons”.
“Therefore, in accordance with democratic principles, it will use all legal means to ensure that justice is done in this case”, adds the leadership of the civic movement, which was dissolved by the transitional authorities.
The Minister of Justice has announced that he will lodge a complaint against Mr Salifou Béavogui with the Council of the National Bar of Guinea.
Mr. Béavogui is one of the FNDC’s lawyers in the case.
“Mr Béavogui will be charged with professional incompetence before the Bar Association, that’s for sure. The remarks contained in the summons are remarks that have undermined my dignity and honour. Legal action will be taken in the coming days,” announced Justice Minister Albert Charles Wright.
