APA-Cape Town (South Africa) High Court judge Nkola Motata is facing impeachment proceedings this week in South Africa’s Parliament in Cape Town after being found guilty of alleged gross misconduct.
The country’s Judicial Conduct Tribunal found Motata guilty of driving while drunk and it recommended that he must be impeached from his post as a high court judge.
The finding comes from a drunk driving case caused by Motata in 2007 when he crashed his vehicle on the boundary wall of a house.
Chief Justice Raymond Zondo formally wrote to parliament last month to inform the National Assembly Speaker Nosiviwe Mapisa-Nqakula about the finding of gross misconduct against Motata.
Motata is the second judge to face the House on impeachment charges.
Suspended Western Cape Judge President John Hlophe was the first judge to face impeachment proceedings in parliament after he was also found guilty of gross misconduct by the Judicial Conduct Tribunal.
The final decision lies with the National Assembly as two-thirds of MPs must vote in favour of the impeachment to succeed.
Last week parliament impeached Public Protector Busisiwe Mkhwebane after being found guilty of misconduct and incompetency in her work, and not fit to hold office.
