The Gauteng High Court in Pretoria on Tuesday granted for former South African president Jacob Zuma leave to appeal against an earlier decision that ruled that his medical parole was unlawful.
Judge Elias Matojane said the case merits the attention of the country’s Supreme Court of Appeal, in particular the question of the correction interpretation of the Correctional Services Act and its regulations.
Zuma has been serving a 15 months sentence since July which was imposed by the Constitutional Court for contempt of court after he ignored an earlier court order to respect summons from a commission probing high-level corruption during his reign.
However, less than two months into his sentence, former correctional services commissioner Arthur Fraser released him on medical parole against the recommendation of the medical parole advisory board.
Matojane ruled on December 15 that the decision was unlawful and set it aside.
Tuesday’s court decision means that Zuma would remain on medical parole until his appeal on the December 15 judgement is heard.
